Kevin Hillman, Pulaski County Prosecuting Attorney announces that in Circuit Court action today, Rachel Valencia of Crocker, pled guilty to one count of Child Endangerment and one count of Possession of a Controlled Substance.  Both charges are class C felonies that carry a maximum punishment of seven years in the Department of Corrections.
In exchange for her plea of guilty, the State agreed to dismiss the other charges currently pending against her. The State also agreed to recommend a sentence of seven years in the Department of Corrections on each count, to run consecutive to one another for a total of fourteen years.  The State recommended that the judge retain jurisdiction under Section 559.115 RSMo with a recommendation for substance abuse treatment while in the Department of Corrections.  This recommendation means that the judge can release the defendant after 120 days if she successfully completes the program and the judge so chooses, and place the defendant on probation for a period of five years.  The conditions of probation, if granted, would be ordered at that time.
After hearing witnesses called by the State and the Defendant during sentencing, Judge Beger took the case under advisement and set it for March 23, 2016 at 9 am for sentencing.
“Our main goal in the prosecution of this case was to make sure that Ms. Valencia did not have a chance to harm any other children,” said Prosecuting Attorney Kevin Hillman.  “While the recommended sentence is not perfect, we determined that we could achieve most of our goals with this plea and sentence and it was not worth the risk of a trial.  In addition, her pleas of guilty bring finality to this case and allow the victims to move forward with their recovery and family court proceedings.”
This case was prosecuted by Prosecuting Attorney Kevin Hillman and Assistant Prosecuting Attorneys Ken Clayton and Kathleen Croker. The Crocker Police Department and Missouri Department of Family Services investigated this case.
