Sneak Peek Sheriff's View / Re: Concerning the Lawsuit filed over 911 by JT
« on: February 18, 2009, 08:16:01 AM »
Good Luck JB  I'm always behind you and no arrows in my hand.

I probably should not answer this post BUT what the heck I am tired of all the arrows in the back. Yes I do have access to a lawyer. I joined the PBA (a police support group) so that I could have access to their attorney. Oops! Their attorney is the guy who filed the case for JT.  I can also ask the attorney who takes most of the cases for the county insurance company. But our insurance company only gave us $10,000.00 to spend on attorney's. The real problem was that while I am named in the LAWSUIT, I am not accused of a single misdeed in the lawsuit. I am only guilty of being the WINNER. So since the ALL of the accusations in the LAWSUIT are pointed at the County Clerk and she wanted an attorney she already knew from the Missouri Association of Counties Association I let her pick Ivan as her attorney and he will also rep for me.

P. S. , I also have a number of other attorney's, mostly local,  who have visited with me in a nice quiet spot to talk LAWSUIT issues and I feel just fine over this affair.

ST. ELIZABETH -- Update, Thursday at 3:49 p.m. :

New details are emerging about the infant found inside of a storage container in Miller County.

The Boone County Medical  Examiner's office performed an autopsy Thursday morning and says that no cause of death was determined. But we were told that the infant is a girl.

Also, Miller County Sheriff Bill Abbott says that there was no visible signs of abuse on the infant. Abbott also said that it doesn't appear that the infant lived past being a day old.

KRCG has also confirmed with Miller County Prosecutor Matt Howard that no one has been charged so far with wrong doing in the death of the infant.

Previous Update:
KRCG News is following a developing story out of Miller County.

Authorities there say an infant has been found dead in the trunk of a car.

The discovery happened during a drug bust in the small town of St. Elizabeth.

Miller County Sheriff Bill Abbott says they suspected people at a house located at 740 Main Street were making methamphetamine.

The sheriff’s department along with the Mid-Missouri Drug Taskforce served a search warrant at the residence.

While looking in the garage they found a plastic storage container inside the trunk of the car.

Sheriff Abbott says when they opened the storage container they found the body of a "very young infant".

After the body was found, the sheriff says they immediately closed-off the area with crime tape and called the Highway Patrol’s Drug and Crime Control Division for help.

The body was taken to University Hospital in Columbia. An autopsy is scheduled for sometime Thursday.

Sheriff Abbott said that he could not release any details about the sex of the infant or how long he or she appeared to have been dead.

Abbott hopes the autopsy will reveal how the infant died.

No one has been charged in the death but KRCG has learned that Sheriff Abbott and Miller County Prosecutor Matt Howard have met to discuss the infant’s death.

Abbott says he expects to make an arrest soon.

Deputies did arrest five people during the drug bust, all are charged with manufacturing methamphetamine.

They are Emily Usnick, Candice Burns, Victoria Stark, Belinda Voiles and John Pawelczak.

The sheriff says all five live at the home where the infant's body was found.

Each is being held on a $500,000 bond.

EMPHASIS: Pulaski County Resident Arrested on Drug Charges

Captain Luke Vislay, director of the Division of Drug and Crime Control, announces the results of a short-term joint narcotics investigation in Pulaski County.

As a result of a short-term narcotics-related investigation by members of the Lake Area Narcotics Enforcement Group (LANEG), a vehicle stop was conducted in St. Robert, Missouri. A canine officer with the Pulaski County Sheriff’s Department assisted with the vehicle stop and his canine partner indicated the presence of illegal narcotics in the vehicle. After a search of the vehicle, officers seized approximately 20 pounds of processed marijuana. The driver of the vehicle was identified as Benjamin C. Johnson, 21, of St. Robert, MO. Johnson was arrested at the scene and transported to the Pulaski County Sheriff’s Department.

Task force officers then applied for and received a search warrant for the Benjamin C. Johnson residence, located at 14990 Turkey Lane, St. Robert. Task force officers and a sheriff’s deputy then served the search warrant. As a result of this search an additional approximate three pounds of processed marijuana was seized, along with five firearms and numerous anabolic steroids.

Johnson was formally charged by the Pulaski County Prosecuting Attorney’s Office with distribution of a controlled substance. His bond was set at $30,000 cash or surety.

The Lake Area Narcotics Enforcement Group is a multi-jurisdictional drug task force. Its members include the sheriff’s departments of Pulaski, Laclede, Camden, Gasconade, and Crawford counties, as well as the Lebanon and Osage Beach police departments. LANEG is governed by a board of directors and is coordinated by the Missouri State Highway Patrol.

The above charge is mere accusation and is not evidence of guilt. Evidence in support of the charge must be presented before a court of competent jurisdiction whose duty is to determine guilt or innocence.
