  • Valor7: Actually no it is not, a dependable Revenue stream will not come on line until the 4th quarter of 2017 so 2018 budget will be up in the air, not quite sure what they will have. By 2019 budget all will be well.

  • Valor7: Yes and no. We talked details and options until we were blue in the face but I never heardbring it over, it was always the time was not right for the issue to pass. Glad to see the time in now right and I for one shall vote yes on the ballot. I would urge all others to do the sameour county is busting at the seams crimewise and no matter how many bad guys we send off there always seems to someone to replace them. The Sheriff's Office needs the help.

$5-per-patron fee was mandated by the Legislature to pay for sexual assault prevention and health insurance
 
A state district judge on Friday ruled that Texas may not collect a $5-per-patron strip club fee that went into effect in January to pay for sexual assault prevention programs and health insurance for low-income Texans.
Judge Scott Jenkins wrote in an opinion that the law, "while furthering laudable goals, violates the First Amendment to the United States Constitution and is therefore invalid."
The Texas Entertainment Association Inc. a group of adult cabarets and Karpod Inc., the owner of an Amarillo club, sued the state last year, arguing that Texas could not tax constitutionally protected speech based on content.
Jenkins wrote that the charge singled out business activity involving nude erotic dancing, "expression that, while politically unpopular, is nevertheless protected."
Last year, the Legislature created the fee, which was expected to raise $44 million a year.
Jerry Strickland, a spokesman for Texas Attorney General Greg Abbott, said the state "will vigorously appeal" the ruling.
"One day after Texans were horrified to learn that a Dallas strip club exploited a 12-year-old child by illegally allowing her to work as a 'dancer,' it is unfortunate that Texas sexual assault victims may not receive the financial support they were promised," Strickland said. The Dallas club's owners have said they didn't know the girl was underage.
Stewart Whitehead, a lawyer for the strip clubs, said he's satisfied with the judge's decision.
"We think the funds from this tax were to go to worthwhile causes, but disagreed with the Legislature's unconstitutional manner of taxing our clients," he said.
Strip clubs would have owed their first payments to the state in April. It's unclear whether the clubs will immediately stop charging patrons the $5.
"Until we get a final decision from a final court, I would expect the fee to continue to be collected," Whitehead said.
Karen Amacker, a spokeswoman for the Texas Association Against Sexual Assault, said her group is disappointed in the ruling and that the fee "is an appropriate long-term, sustainable funding source for programs addressing sexual violence."
Amacker said the Texas Association Against Sexual Assault plans to continue to push for the fee.
"We're prepared to do what it takes to make sure that sexual assault survivors and citizens in the state of Texas are served," Amacker said.
In his ruling, Jenkins wrote that although the defendants Abbott and Comptroller Susan Combs showed a link between the strip clubs and sexual violence, they failed to show a link between strip clubs and a lack of adequate health insurance.
Amacker said her group makes no claim that strip club patrons "are more or less likely to perpetuate sexual violence."
She also said, however, that "It can be reasonably concluded that an industry that flourishes by objectifying women does impact the attitudes and beliefs that support sexual violence."
But in his ruling, regarding the health insurance link, Jenkins wrote: "There is no evidence that combining alcohol with nude erotic dancing causes dancers to be uninsured, that

No.  I do their ads, design work and some small amount of business consultation.  I don't run their business.  I work more with nightclubs.
