JCT Confirms Failure to Comply with Democrats’ Mandate Can Lead to 5 Years in Jail
Friday, November 06, 2009

Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail.  The JCT letter  makes clear that Americans who do not maintain “acceptable health insurance coverage” and who choose not to pay the bill’s new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.
In response to the JCT letter, Camp said:  “This is the ultimate example of the Democrats’ command-and-control style of governing – buy what we tell you or go to jail.  It is outrageous and it should be stopped immediately.”
Key excerpts from the JCT letter appear below:
H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.”[/] [page 1]

                                                         - - - - - - - - - -

If the government determines that the taxpayer’s unpaid tax liability results from willful behavior, the following penalties could apply…”[/] [page 2]

                                                         - - - - - - - - - -

Criminal penalties[/]
Prosecution is authorized under the Code for a variety of offenses.  Depending on the level of the noncompliance, the following penalties could apply to an individual:
• Section 7203 – misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.
• Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.” [page 3]
When confronted with this same issue during its consideration of a similar individual mandate tax, the Senate Finance Committee worked on a bipartisan basis to include language in its bill that shielded Americans from civil and criminal penalties.  The Pelosi bill, however, contains no similar language protecting American citizens from civil and criminal tax penalties that could include a $250,000 fine and five years in jail.
“The Senate Finance Committee had the good sense to eliminate the extreme penalty of incarceration.  Speaker Pelosi’s decision to leave in the jail time provision is a threat to every family who cannot afford the $15,000 premium her plan creates.  Fortunately, Republicans have an alternative that will lower health insurance costs without raising taxes or cutting Medicare,” said Camp.
According to the Congressional Budget Office the lowest cost family non-group plan under the Speaker’s bill would cost $15,000 in 2016.

This is breaking news worthy of a Teabag Revolution, Part Deux!!!!

This is the very very first time in the history of the UNIVERSE that a law carries PENALTIES for violating it!!!

STOP THE FREAKING PRESSES!!!

BREAKING NEWS ALERT!!!

Violating a law now carries a punishment.

The Democrats must be stopped!

They are making laws that punish violators!

Better to lock up Tommy Chong for 6 months in a federal prison for selling bongs online.

Ummmmm What does this accomplish?  Aren't the tax payers responsible to pay for health care for inmates?

Seems to me this is the first time in the history of the US that you have to buy a product just to be a citizen.   This is NOT good for small business owners!

This is far from the first time small  (or medium, or large) businesses have had to comply with a federal, state, county or local law that required them to pay a sum of money or face civil and or criminal penalties, to include fines and or jail time.

Seriously, do they think we all just fell off the turnip truck?

Car insurance is only needed for those who use the privilege of driving.  If you don't drive you don't need the insurance (which, by the way, is a HUGE number when you consider how many people don't even own cars in urban areas).

As a small business owner I can tell you that small business associations across the nation (including the Chamber of Commerce) is ABSOLUTELY against this.

As I've said many times before;  I'm all for health care reform but this is NOT the time or economy to put more stress on the heartbeat of the nation's economy -- small business owners.

I hope you like those turnips..... if Obama and his Dems have their way that's what we'll all be eating 3x a day!

The car insurance requirement is a state law (many states have versions of it now).  It was intended to lower the cost of auto insurance, it has not.  Actually, right after being put in place in MO auto insurance rates jumped because insurance companies knew they had a product you MUST have if you wanted to drive, of course at the time they said it was because of the requirement of the government to process all of the new people.

The insurance lobby was the ones that pushed that legislation, I was on the board of directors of an insurance company at the time and was the only vote on our board against supporting the legislation the way it was written and to be put in place.  With all of the loopholes, I still feel I was right.

I am sure that won't happen with health care especially when adding in pre-existing conditions. /sarcasm

What gets me about this post is this.......

Quote

Looks to me like we will have a 2.5% Income Tax Increase plus have to pay to maintain Health Insurance or go to jail.

who will enforce this? my guess the irs. it won't pass the senate,I hope. winston should read the bills(all 4 versions) so he will know what he is talking about. many have no clue how the health care scam takes away our freedoms. Where you work, where you live, what you live in,what you eat, our everyday life will be tied to healthcare. the gov't will have almost total control of our lives.

I have read a couple of them (of course they have changed some) and I don't remember which one it was in, but yes in one of them the IRS was the reporting agency.  Since they can track your finances, it was a natural for them to be the ones to see if you are meeting the government's requirements in both having the mandated insurance and making sure it was on their list of approved policies/coverage.
