Dear Mr. Hillman,

I have a question if you wouldnt mind answering especially for others out there in the same situation...

You are going to rent a home. The home was previously rented to tenants who had their electric & water shut off. They continued to live there for another 3 months. Never paying rent. They abandon the place leaving personal belongings and trash beyond what you can comprehend. You make an agreement with the owner to rent it and in doing so, clean it up for no deposit and first months rent.

Family of the tenants who abandoned it have had a key and have also been there on their own to get clothes for one of the children. Never bothering to get anything else or clean it up. However, the NEW tenants go in and clean it up and burn what was in there. They do keep a few furniture pieces in doing the job.

The family of the past tenants then start calling, texting and talking about the situation all over town and in the meantime the new tenants even offer them to come over and go thru what is outside before they burn. They get what they want and leave. Then call, threaten, harass you stating that you have other stuff of theirs and they are going to so called get you for stealing???? 

Can you please explain to me how this is possible being they WERE NOT the individuals renting the property to begin with.

The place was abandoned for 6 months and no one coming and doing a thing until new tenants went to clean it up and move in.

They were given the oppurtunity to come and get what they wanted but then failed to return for anymore even after asked to.

The new tenants had NOTHING to do with the damage nor trash or property that was left abandoned all they did was cleaned it up so they could move in but are now being threatened and harassed?

What can be done?

Post the before pictures so everyone can see what pigs these people were.  Don't have to name names, just show how they lived and how they let their kids live.  Also get the landlord and the sheriff involved.

The landlord is involved he is going today to change the whole door and put up no trespassing signs. And when they show up the sheriff WILL be called however, they are best friends with chief of police in crocker and think they have some kind of power to continue to harass and text and threaten! I am NOT sure if he is giving them this input or what? But I DO understand a little bit about the law and the past tenants abandoned and destroyed the property and ONLY because their family happen to know me as the new tenant do they think they can do something now! I am so sick of it! I have told them time and time again that it is all burned and they aren't getting anything else! If they wanted it that bad they should have gotten it along time ago AND BEEN THE ONES TO CLEAN IT UP! They even got on my facebook and copied the pictures I took saying they can use them as evidence that its their stuff and I stole it!!? ??? It is unreal. I have enough on my plate trying to clean up the mess and get myself moved in before the 1st all by myself with my roommate. I don't need this drama. But they do read this forum so I figured Mr. Hillman could answer it for them. I don't have time to be wasting arguing and fighting with them nor explaining my position.

You should just ignore them.  Delete the texts and don't read them.  You do have enough on your plate.  You don't need all that.

No I dont and your right and I have been but...they are telling so many people that they are calling me asking me what is going on! I dont have time to post the pics but will. I have to make the files smaller and just dont have time. Have to get over to the trailer today as yesterday I went to DR. and was sick and sore I had to take a break. Still sick today as it , along with the stress has me hurting and sick but I have to get it done. So... Im passing the buck to someone else to tell them. They sure arent listening to me!

It would seem that if a tenant abandons personal property, then it would belong to the landlord.  The landlord gave it to you.  And former tenant's family is just out of luck.  Lol, put the stuff that's left on here for sale and they can buy it back.  Your time cleaning it is worth something!

Just to let everyone know the tenants moved out in February not 6 months we only had the key for 2 weeks but during that time my mother was in the hospital then when she got out my sister went in  then passed away would you really feel like going some where and going through stuff at that point and time. I'm sorry but i didn't. Yes I admit I seen the trailer I don't see how anybody could live in those conditions and make a teen girl live there was just wrong. The only things we wanted was the things that the tenant stole from us and her family.

Your beef is with the owner/renter, not the tenant. She (guessing it is a she) made a deal with the renter, and appears went beyond what she is required by law to assist you. If you feel items are missing, you need to take the owner to court, not hassle the current tenant.

I'm sorry for your loss.  I know how it is to lose someone and then have to deal with all the issues and aftermath.  However, if the owner rented the place out and told the new tenant they could clean it up for help with the deposit and 1st months rent, then I wouldn't call that stealing.  If those things are still around then they should give it back.  That's the charitable thing to do.  Like I said, if there are things that belonged to the lady who lived there, those items should be returned.

The new tenant did let us get some of the stuff but then i got called back to work and had to leave then she burnt the stuff the next day and said we could not have it.

She is not the owner of the trailer~ her boyfriend and his dad are~ and the previous renters moved out in December not Febraury~ they had til February to get their junk out which they did not do~ Its all gone now and it aint coming back so everyone needs to let it go...  What furniture that they kept was not yours of your sisters it belongs to my kids grandma~ they had chances to get it and chose not too...

For one I was not on here today (her sister). I don't think anyone said anything about furniture. So you guy can drop it. The only person doing the text and attacking people is the one who started this post and talks about stuff she has no business in talking about. She need stop .

She didnt steal them from you!??? are you crazy??? she left it there, abandoned it!! Your mad about that ok... understand... but you have NO right to take it out on the people who got off their butts and busted their butts to clean it!! THANK YOU SO VERY MUCH TAZ! You are correct! I cant deal with any of this anymore. My health is bad enough than to have to hear stuff around town and people calling asking what is going on.
And they had my phone number because I was friends with Greek Meadow and cared about her and checked on her.

The law on abandoning property by a tenant is tricky and there are some requirements that need to be followed prior to disposing of the property by the landlord. I am not saying you did anything wrong, I just don't know. I would suggest that you speak with a civil attorney about those steps.  It has been a while since I filed an eviction action so I don't want to give you bad advice.
 
If someone is harrassing you, you can always file for an order of protection on the 2nd floor of the courthouse with the Circuit Clerk.

"Stalking" by current law is when someone contacts you in two different ways. (For example they call, and text you.) This is a federal offense.

yes I knew all of this but they are accusing me and I am just the person who is going to be renting it. 
I have tried to be nice by allowing them there to get the items when told to call the cops by the landlord. He has all the dates and facts. Its not even their property and they weren't even the tenants.
However, I am being accused and harassed and I do know to get an exparte order, I have been told to do so by an attorney who has also seen the pictures. If it leads to that then it has too because I cant deal with any of this anymore I am just trying to get moved into a rental. I hope it don't I have other things to do.

I realize that everyone is upset, but please keep the tone civil here before it becomes a matter I have to deal with as the prosecutor, which no one wants.

If a tenant abandons his property you take it and store it, then you go to the second floor of the courthouse and pay about 100 dollars to have them served with papers, depending on different circumstances this could cost an additional 100 dollars to have the papers served.. My numbers may not be accurate but they are close..

It's a horrible thing all the way around and I can see both sides but I do have to say that I live in Crocker and didn't know who listening was talking about until Dragonslayer piped up... while there were those who did, most probably didn't. Just commenting as an outsider. Because i know there are a lot of hurt feelings and a lot of greiving going on and it's sad but that seems to be when the poo hits the fan... times like this when just too much has happened for one person to deal with. I hope everyone can get this sorted out without publicly ridiculing each other any further. My prayers for all involved.
