  • nursejdavis: I am looking for a few Press Releases from Kevin Hillman that have disappeared.... not sure why they would be hidden from the public unless they contain narcs who have gotten their charges dropped for their cooperation. Seems the same Press Releases were also deleted from Facebook. Thanks for any help in locating these

  • Valor7: Yes and no. We talked details and options until we were blue in the face but I never heardbring it over, it was always the time was not right for the issue to pass. Glad to see the time in now right and I for one shall vote yes on the ballot. I would urge all others to do the sameour county is busting at the seams crimewise and no matter how many bad guys we send off there always seems to someone to replace them. The Sheriff's Office needs the help.

2nd deg murder, a jury of 12 and beyond a reasonable doubt.  Unless the bullet shows entry through the kid/young adults back self defense is solid.  Even if the kid had no powder residue on his wound entry he was facing Z and possibly still portraying a threat.  He may have been backing up to give him a thug kick to the head.  Still good shot. Even if kid was yelling help while banging this guys head into the ground good shot.

If I ever commit a crime I'm going to scream help so I'm the victim

I disagree with you. If someone walks up and punches you,You have reasonable doubt that they are gonna stop hitting you causeing major bodily harm or death and I feel you have a legal right to defend yourself by shooting them.I will pull a gun every time Im attacked I assure you. Older people injure more severely than young bucks so we have to be extra careful. Thats my opinion

Im not really interested in your opinion of reasonable expectation of force, Im more concerned about case law and statues on the matter.

Reasonable expectation of force has some elements to it and it is part of the statutes in this state.  Read RSMo 563 and 571 for information.  Additionally, you might take a CCW course and learn about those expectations first hand.  I am interested in waiting for the facts to come out in court instead of convicting a person through the lame stream media.  But if you want facts, I gave you the proper area to look.  Not wanting to confuse your opinion with facts though.

Florida's "Stand Your Ground" law allows the use of deadly force as long as you:

  • Are not engaged in an unlawful activity.
  • Are being attacked in a place you have a right to be.
  • Reasonably believe that your life and safety is in danger as a result of an overt act or perceived threat committed by someone else toward you.
Also don't want you to work too hard at getting to statutes.  Ooops, Florida Statute:

776.032 Immunity from criminal prosecution and civil action for justifiable use of force.— (1) A person who uses force as permitted in s. 776.012, s. 776.013, or s. 776.031 is justified in using such force and is immune from criminal prosecution and civil action for the use of such force, unless the person against whom force was used is a law enforcement officer, as defined in s. 943.10(14), who was acting in the performance of his or her official duties and the officer identified himself or herself in accordance with any applicable law or the person using force knew or reasonably should have known that the person was a law enforcement officer. As used in this subsection, the term “criminal prosecution” includes arresting, detaining in custody, and charging or prosecuting the defendant.
(2) A law enforcement agency may use standard procedures for investigating the use of force as described in subsection (1), but the agency may not arrest the person for using force unless it determines that there is probable cause that the force that was used was unlawful.
(3) The court shall award reasonable attorney’s fees, court costs, compensation for loss of income, and all expenses incurred by the defendant in defense of any civil action brought by a plaintiff if the court finds that the defendant is immune from prosecution as provided in subsection (1).History.—s. 4, ch. 2005-27.

This is how I see it. Zimmerman saw a person he thought was suspicious. He called it in to 911. The operator told him that they would send somebody. He tells them he is going after the person and they tell him no, let law enforcement take over. Now, he could of stayed in his vehicle, followed him in his vehicle and monitored him. Instead he went after him on foot. That is all we know are to be facts.
The rest could have gone a number of ways. I do not buy all of Zimmerman’s story.  I have a feeling that he said or did something that provoked Trayvon.  I do not believe the kid just walked up and busted his nose and attacked him like that. I think Zimmerman started something and ended up on the short side of the fight and pulled a gun and shot him. If he had a broken nose, he would have had black eyes. I know mine has been bust numerous times (I played Hockey and Lacrosse for many years). But again, this is all speculation on my part. The facts are above, and all we know is he followed the kid on foot, and the next minute there is a dead teenager.
I don’t think Zimmerman is guilty of murder, but he is responsible for the death of this kid (and I could care less if he was a punk, I was a punk as a kid too as were many of you, does not mean we needed to be shot). He is responsible for the death of this kid based upon his actions that caused the teenager to attack him, when he was told to leave it alone. I do not care if the 911 person has authority. He called and reported the suspicious person, and should have left it at that when he was told that officers were on the way. What we do not know as facts are what happened from the time he followed the teenager to the time the teenager was hitting him.
If he did anything that provoked the teenager, like grab him to apprehend him (which I truly feel he did), or something else that made Trayvon feel threatened enough to attack him, then by him then pulling a gun and shooting that boy, he is guilty of manslaughter at the least, because by his actions he pushed that boy into a situation where he felt he needed to attack Zimmerman.
Bottom line, I do not see Zimmerman as the innocent person protecting his community. I see him more as someone who felt being a crime watcher gave him special powers to act like a police officer and it backfired, and as a result a teenager died.
