FORMER PULASKI COUNTY SHERIFF’S DEPARTMENT TRANSPORT DEPUTY CHARGED WITH SEXUAL CONTACT WITH AN INMATE
Kevin Hillman, Pulaski County Prosecuting Attorney announces that Donald E. Sapp, DOB: 3/1957 of Lynchburg, Missouri was charged by Morgan County Prosecuting Attorney Dustin Dunklee with one count of Sexual Contact with a Prisoner.
 
In early January, a Pulaski County inmate disclosed to Pulaski County law enforcement officers that she had engaged in sexual activity with a Pulaski County Deputy during a transport from the Chillicothe Correctional Facility to the Pulaski County Jail.  Pulaski County Sheriff Jimmy Bench immediately contacted the Missouri State Highway Patrol and requested the Division of Drug and Crime Control (DDCC) initiate an investigation into the matter.  Sheriff Bench also placed Deputy Sapp on a leave of absence, ordered him to have no contact with the Department and Deputy Sapp resigned his commission with the Sheriff’s Department soon thereafter.
 
DDCC immediately began an investigation and obtained two search warrants with the assistance of the Pulaski County Prosecutor’s Office for DNA and a cell phone.  In addition, DDCC conducted several interviews.  In the process of this investigation, it was determined that the sexual activity most likely occurred at a conservation area located in Morgan County.
 
DNA results were obtained in late June confirming details of the inmate’s story.  On June 29, 2017, DDCC investigators submitted a probable cause affidavit alleging the offense of Sexual Contact with a Prisoner.  After coordination between the Pulaski County Prosecutor Kevin  Hillman and Morgan County Prosecutor Dustin Dunklee, it was determined that the best venue for criminal charges was Morgan County as the sexual acts occurred there.
 
On July 5, 2017, Morgan County Prosecutor filed a complaint in the Circuit Court of Morgan County alleging one count of Sexual Contact with a Prisoner and requested a warrant.  Judge Stephen Grantham issued a warrant in the amount of $50,000 cash or surety.
A copy of the complaint and probable cause statement are attached.
 
The Prosecutor’s Office reminds everyone that these charges are merely an accusation and the person named herein remains innocent until proven guilty in a court of law.
