Thanks to George for getting involved again, and I cannot imagine that this could be legal. How do so few people get so much power? I guess we have allowed that to happen. I don't live in Waynesville, but this whole thing is scary to me. I can only hope that Waynesville residents can get this stopped and things don't get worse. Lord knows things like this get people hurt and killed. Look at Dent Co. a few years ago.

What happened in Dent county a few years ago?  I don't live too many miles from their county line.

If my memory serves, and some of the details could be wrong, but a landowner felt he was being encroached upon by a county entity (maybe sewer) and refused to let them on his land. After a long and rancorous chain of events, the county entity person showed up with a deputy. The landowner had a gun. Things escalated and the deputy was killed. It seems to me that the deputy and the landowner had been friends. Sad all around.
I have it on good authority that the Hokey-Pokey really IS what it's all about.

I remember that, but it seems like there were 4-5 lawmen/women who were involved in that fiasco.
....and that night as the moon crossed the mountain, one more Coyote was heard...

What happened to the landowner?  I ask, because some laws have changed since that happened, not to be a smart a$$.  Curious is the word.

Is the City Council meeting still scheduled for tonight?  It will be interesting to see how the vote goes for the new ordinance.

I believe that incident started somewhere else and ended up there. The one I am talking about was not a criminal case in the beginning, just escalated when the county entity people called in law enforcement to make him let them on his property.

It may be too late to influence this regulation. All such actions, undertaken by despots have unforseen results. The very title "warrant" infers that refusal to comply may result in arrest. That means that "they" can respond with armed force. But, then again it's for "mutual goals" and the law won't be used to "harass" . You better not use the term "nazi" because that is "over the top"-Ohhh, if only the council could make a law permitting them to silence you, make you shut up and take it for the good of all. The "common good" argument has always been used by tyrants-and yes we have them right here. They know what is best, they will guide you, and if you won't follow-they will "bust" you. It is the arrogance of a very few-negating your rights to bolster their egos. And Luge, you are correct-the nazis would do it differently-and, there was a pretty good size nazi party in the US in the late 30's. Now, there is a strong socialist influence.
Good citizens, please remember to vote. Please remember that you do not own property in this state-you only rent. The irony that stepping across a line into the county you reach a slightly higher level of freedom.

The way I see it, and I am probably wrong, since this "warrant" is administrative, you have broken no law.  They do not have the right to trespass on your property, officer or no officer.  The only right they have is to vacate the property forthwith.  One thing to do is to REFUSE to open your door or go outside to confront the trespassers.  They cannot serve you if you do these things.  Remember, they MUST serve you with the warrant.  Failure to do so will leave them open to criminal liability for any and all property stolen from you.  And believe me, they WILL steal.  Not confiscate.  Anyone remember a thing about Bills of Attainder in your history?  Remember, you have broken no law by refusing admittance to the despots.  Hold them in the contempt they deserve.  Vote those out that voted for this little gem of "law".  I am in the county and will remain so and I cannot assist you in voting them out, only encourage.

Well said Waita and matrsnot!!  Very well said!

I can't wait to put my house up for sale, this is ridiculous and unneeded in my opinion.  Everyone that buys a house or is looking to buy a house  or open a business in waynesville needs to be made aware of this ordinance, I surely would not have bought my house if I had known this.  When everyone moves to the county who will be responsible for the upkeep of all the vacant homes city council?  Fines could have been imposed or varous other methods that were not so extreme.  But you all have the left the door wide open for this ord. to be abused long after you are out of office, what if we the people don't like what your yard or business looks like.  I happen to live on Sunset and as I drive down my street I see no house or property that mandates an administrative search warrant nor being singled out on this site,  I do however see my neighbors.  They are not living in unhealthy conditions they may have cluttered stuff and vehicles but this is not unhealthy or dangerous to me or my children or yours.  If you don't like the way our neighborhood looks then don't buy a house here go to the next, but don't infringe on our rights for the betterment of the community.  For the betterment of the community look along Bus, Route 66 where all of us have to look daily as well as visitors and potental business owners, not in our neighborhoods, not where we choose to live, the way we choose to live.  With this ord. in place we could potentially lose businesses and home owners.  And each and every person looking to buy, rent or open a business should be made aware of this ord.. This invasion of our rights!   City Council was wrong in this decision and all who voted should be booted out as well as the Mayor!  Shame on all of you and if the Nazi shoe fits WEAR IT!
